First ticket with Isf should I fight it?

So the other day i have my cruise set to 80. When out of no where a trooper gets behind me and cuts his lights on. I pull over and the young punk tells me I was doing 90. I say not possible as I hand him my insurance. Im not worried as I was thinking I would get a warning cause i was not doing 90. He comes back, but with a ticket. I say I couldnt have been doing 90 I had my cruise set. He just shrugs his shoulders and tells me he hears that all the time. I then ask to see his radar gun. He looks at me crazy and says the speed isnt on it. I said then how do u have me at 90. He tells me he cut the gun on and estimated my speed. WTF!

Now I could have swarn i had the right to see the gun to check calibration dates and see my time. I was caught in fort myers which is about 2 hours from me. Should I go to court or just pay the 275 and say fuggit.

It's up to you if you want to fight it. I can only talk intelligently about WA St law, so here we go. It is not the driver’s right to look at the radar gun or anything on it. The officer does not have to let the driver out of the car at all since it can become a safety hazard for both of them, and the cop is liable for the driver if he lets him out of the car and he gets hit by a passing car. The easiest thing to do is pay it, but that really sucks and can hurt your insurance. Instead of fighting it, which would come down to your word against his, get a lawyer that specializes in this sort of thing and get it changed to something else. I know a guy that had a $280 speeding ticket changed to expired tabs and still had to pay the $280 (the court clerk said she didn't care what it was called, they just want the money). Now this didn't hit his insurance because it was changed from a moving violation.

It is going to suck no matter what you do cause they get their money.

I think it depends on the state. WA you can go 100 over and it isn't criminal. It becomes criminal if the cop writes you a ticket specifically stating that type of infraction (i.e. negligent driving, reckless driving, etc).

You ain't getting community service LMAO, just send in the ticket with the fine, and plead "NOT GUILTY", They will assign you a court date. On that date go in to court and simple ask for the "Mercy of the courts" i.e. leniency. The judge will likely reduce the speed, or assign you a "non moving" violation. Meaning you will NOT get any points, thereby affecting your insurance rates. Do NOT go into court like some dumb A Z Z and think you are going to play Sherlock Holmes, and do the whole me versus him thing, YOU will loose that battle EVERY TIME! The attitude of "the officer is right", I was speeding and was simply NOT paying attention, please help with the points "Your Honor" will get you far in this game, remember all they really want is the fine, not to screw up your life.
As a side note gentleman and ladies, the side of the highway is NOT the place to argue your "self believed" innocence, simply say and do exactly as the officer asks, do NOT argue, or be ignorant!, this will only cost YOU money! Remember most officers earn overtime pay to go to court, you are only making their extra dollars earned even MORE enjoyable by pissing them off! The proper procedure to follow when pulled over is such, 1a. Pull over as soon as safely possible in a area which is safe for the officer to exit his vehicle, (HINT, a large berm on the side will do or a near buy parking lot would be nice. 1b. if it is dark out turn on the interior lights. 2. Keep your hands on the wheel where the officer can see them, (do NOT start jumping around the car scrambling for your misplaced registration and or insurance cards!, you will IMMEDIATELY make the officer nervous! a nervous man with a GUN is a BAD THING!. 3. The officer will say good evening Miss or Sir may I please see your paper work and license, they may even ask you if YOU know why they stopped you? (HINT, this is NOT a trick question, and you would do well to be honest here.) if you do know the reason, A simple "No Officer I do not." or "Yes Officer I do, I apologize, I simply was NOT paying as close attention to my speed as I should have been." will suffice. (you would be VERY surprised at the results when a little "common courtesy" is used when addressing the officer.:D When the officer is done with his job (which is running your information, making sure you are NOT a wanted criminal, and you are whom you say you are, and that your paper work is valid) he will return with your information, and have you possibly sign the citation, or more than likely (if you were a "well mannered" individual) warning slip, You and he both will be safely on your way. I can NOT tell you how many hot heads get re-pulled over because after their verbal onslaught went tearing off without using their signal, and or shooting the officer with dirt and rocks only resulting in being more pissed off because the get cited for "reckless driving" and "failure to signal". All of which will stick in court, and NONE of which will be overturned via the judge. I hope this helps in this matter, and all your future endeavors.

I did pretty much exactly what you said and was completely courteous. I still got a ticket and the trooper was still an ass. Oh well. I just went ahead and paid it because I didn't have an attorney at the time. Thankfully my rates haven't gone up so far. It is my first speeding ticket ever.

You need to make friends with a lawyer, they have the influence to reduce and alter tickets.

I personally think the whole points system scare is BS... I have two speeding convictions on my record in a year and no raise in insurance... I pay every 6 months. If you switch insurance companies you are likely to see the penalty, but otherwise it really isn't an issue. Just never bring it up to your insurance agent. You are less likely to get a premium raise if you are using a big company like Geico where your account is managed by a huge information system rather than local agents.

RCW 46.61.465 defines reckless driving as The unlawful operation of a vehicle in excess of the maximum lawful speeds provided in this chapter at the point of operation and under the circumstances described shall be prima facie evidence of the operation of a motor vehicle in a reckless manner by the operator thereof.

so technically even 1mph over can net you a reckless charge in Washington. :eek:

In Arizona its more clearly defined at 20+ or over 85. I had a criminal ticket in which the officer marked civil. I asked for traffic school since it was a "civil" offense however the judge said that the officers call doesn't supersede state law and thus it was still a criminal offense and I was ineligible for traffic school. I ended up pleading not guilty got a new court date and that judge let me go to traffic school :)
I usually get a warning. THe first day I got the car I was driving back from ga. Im doin 75 in gainsville when I see the cop and another car in front of me. I slow down and drive next to the cop. THe other car leaves both of us and the cop car slows down and gets behind me. 5 mins later the lights come on and he pulls me. I was really doin 75 and he tells me I was speeding, he said he clocked me behind him. WTF THis whole time my wife is cussing me out. lol HE runs my info and then asks what year the car was. Im like wtf. He gives me a warning And I leave. I think it was a case of dwb.
